Wolontariat w Polsce - prawo a praktyka

Uchwalenie w 2003 roku Ustawy o działalności pożytku publicznego i o wolontariacie oraz wprowadzających ją przepisów zasadniczo zmieniło warunki wykonywania pracy społecznej i sytuację prawną ochotników w Polsce. Z działalności nieformalnej, jaką do tej pory był wolontariat, praca społeczna stała się aktywnością w pełni legalną, określoną przez zespół praw i obowiązków wolontariuszy oraz podmiotów korzystających z ich pracy. Tym samym wolontariat został zinstytucjonalizowany. Ale czy przypadkiem nie został też "przeregulowany"? Autorka prezentuje wyniki swoich badań, które wskazują na częstsze przestrzeganie zasad prawnych w instytucjach publicznych, chociaż zarówno one, jak i organizacje pozarządowe nie zawsze stosują się do wszystkich reguł. Częściej respektowane są reguły obligatoryjne, fakultatywne zaś znacznie rzadziej, co wskazuje na niską zdolność polskich organizacji do praktyk samoregulacyjnych i stanowi potwierdzenie, że taka ustawa jest potrzebna.

Volunteer Work in Poland - The Law and Practice

Promulgation in 2003 of the legislative Act regarding public utility activity and volunteer work along with its accompanying statutory instruments has brought a significant shift in the conditions for performing social work and in the legal status of volunteers in Poland. Community service has morphed from an informal activity to a legal institution, thoroughly regulated in reference as to the rights and obligations of volunteers and of those benefiting from their work. So volunteer work has been institutionalized - and, perhaps, also overregulated ? The author cites results of her research which indicate that public institutions are more likely to abide by all pertinent laws, although neither they nor the NGOs follow all the rules to the letter. Rules of absolute application are respected, at least most of the time, but those of a facultative nature tend to be ignored. This may be indicative of poor self-regulatory skills among Polish NGOs, suggesting that statutory regulation is very much called for.
